Client responsibilities

Clients are responsible for providing accurate, complete and timely information, materials, approvals, access credentials and other resources reasonably required to perform the agreed services.

• Provide materials and approvals within agreed timelines
• Ensure supplied content is lawful and authorised for use
• Review deliverables and communicate required changes
• Maintain access to third-party accounts where applicable

Delays in receiving information, approvals or access may affect project timelines.

Fees & payment

Fees and payment schedules will be communicated in the applicable proposal, quotation, invoice or service agreement.

Unless otherwise agreed in writing, work may be paused where an invoice or agreed payment remains outstanding.

Third-party costs such as advertising spend, software subscriptions, hosting, domains, platform fees, stock assets or other external charges may be separate from The Orion Media's professional service fees.

Content & intellectual property

Clients remain responsible for ensuring that materials they provide to us can legally be used for the agreed project. This includes photographs, video, music, logos, trademarks, copy and other supplied assets.

Unless otherwise agreed in writing, ownership and permitted use of final deliverables may depend on the applicable proposal, invoice or service agreement and settlement of agreed fees.

The Orion Media may retain ownership of its pre-existing systems, templates, processes, know-how, concepts and reusable production methods unless expressly transferred in writing.

Third-party platforms

Our work may involve third-party platforms including advertising networks, social media platforms, website services, analytics tools, payment providers, hosting providers and other technology services.

These platforms operate independently and may change their policies, algorithms, availability, pricing, features or approval requirements. The Orion Media does not control third-party platform decisions.

Clients are responsible for complying with the terms and policies applicable to the third-party accounts they own or operate.

Results & limitation of liability

Marketing and advertising performance can be affected by factors outside our control, including market conditions, competition, platform changes, audience behaviour, budgets, offers, pricing, website performance and client execution.

Past results, case studies, testimonials, examples and performance figures shown on this website are illustrative and should not be interpreted as a promise of future results.

To the extent permitted by applicable law, The Orion Media is not responsible for indirect, incidental, special or consequential losses arising from use of the website or services.

Termination

Either party may end a service engagement according to the termination terms agreed in the applicable proposal, quotation or service agreement.

Amounts due for work already completed, approved expenses or committed third-party costs may remain payable after termination, subject to the applicable agreement and law.
